Guarantees

Right to withdraw from the contract:

The user has the right, without incurring additional costs and without giving a reason, to cancel the contract concluded online within 14 days and to return the product, even if he purchased it at a discount or during a sale (exceptions, which contracts cannot be canceled, are provided for in Article 6.22810 of the Civil Code). The returned product must be undamaged, unused, and in its original appearance. If the trader has not informed the consumer about this right, the consumer can withdraw from the contract within 12 months.

• The user must inform the entrepreneur about the withdrawal from the contract by submitting a properly completed model contract withdrawal form (it should be placed in the e-shop) or by clearly stating the wish to withdraw from the contract. The consumer must return the goods to the entrepreneur no later than 14 days from the date of such notification

• After receiving the consumer's notice of withdrawal from the contract, the entrepreneur must return to the consumer all the amounts paid by the consumer, including the costs of delivery of the goods paid by the consumer, within 14 days.

• The entrepreneur may not refund the sums paid to the consumer until the goods are returned to the entrepreneur or until the consumer provides proof that the goods have been sent to him.

Legal guarantee:

In Lithuania, as in the entire European Union, goods are provided with a legal guarantee of at least two years. This means that if the product is of poor quality, the seller must repair or replace it free of charge, and if this is not possible, reduce the price or return the money paid. The user does not have the right to terminate the contract if the lack of the item is minor.

• The user can use the legal guarantee even if the product is of high quality, but does not correspond to the promotional product description provided by the seller at the time of purchase.

• The cost of returning a defective product is borne by the seller. In such a case, the seller does not have the right to deduct the tax for the loss of the value of the goods or, after replacing the poor-quality goods with goods of suitable quality, to ask the consumer to pay the price difference.

• After submitting a claim for the application of the legal guarantee, the user must submit the application and documents confirming the purchase of the product.

The goods are considered to be of poor quality if the goods have expired, the goods contain ingredients prohibited by legislation, the consistency or other essential characteristics of the goods have changed due to improper storage conditions before the goods are handed over to the Buyer, the goods are mechanically damaged, their packaging is damaged or there are other defects in the quality of the goods. .

The Buyer has the right to return to the Seller the goods ordered or purchased in the Electronic Store, which are not specified in these return rules, by renouncing the concluded goods purchase and sale agreement for all or part of the goods in the order. In order to exercise this right, the Buyer must:

not later than within 14 (fourteen) days from the day of handing over the goods to the Buyer, inform the Seller about the contract cancellation at his e-mail address info@herba.lt, by filling out the contract cancellation form;

- not later than within 14 (fourteen) days from the date of the Seller's notification of the withdrawal from the contract, as provided for in Rule 7.3.1. point, hand over the goods to the Seller together with the purchase document (purchase receipt and/or VAT invoice) and other related documents (for example, the warranty maintenance booklet);

Quality goods to be returned or exchanged must be undamaged and in their original appearance (labels not removed or damaged, protective film not torn off, etc.) and cannot be used. The product must be returned in its original packaging, in the same configuration as the Buyer received, with the purchase document, warranty card (if issued), instructions for use and other product accessories. If the product is not complete, is damaged, untidy or not properly packed, the Seller has the right not to accept the product, not to exchange it and not to return the money paid by the Buyer for the product.

The right provided for in these Rules can be exercised only by the Buyer who is considered a consumer according to the legislation, i.e. a natural person who declares his will to buy, buys and uses a product to satisfy personal, family, household needs, not related to business or profession. Goods of inappropriate quality are exchanged or returned in accordance with these Rules and the legal acts of the Republic of Lithuania in force at the time of purchase of the goods.

Goods can be transferred (returned) to the Seller:
- if the Buyer collected the goods at the Seller's office, the goods are returned upon arrival at the Seller's office;

- if the goods were delivered to the Buyer by a courier, the goods are returned to the Seller's office at the Buyer's option;

In cases of return of goods specified in the rules, the money paid for the goods is returned to the Buyer:

- if the Buyer paid for the goods through the electronic banking system used by the Buyer or by advance bank transfer, the Seller returns the amount paid for the goods to the buyer within 14 (fourteen) days from the day of returning the goods, by transferring the money to the bank account of the payer for the goods. If the purchased goods were paid for in cash by paying them to the courier at the time of delivery of the goods to the Buyer, the Seller returns the amount paid for the goods to the buyer within 14 (fourteen) days from the day of the return of the goods by transferring the money to the bank account of the payer for the goods.

If the returned goods were delivered by courier, i.e. i.e. The Buyer has chosen the method of delivery of the goods, which is subject to an additional service fee, the Seller has the right to deduct the costs incurred by the Seller for the delivery of the goods from the amount paid for the goods returned to the Buyer.
